2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Section 356 and 379 of the Indian Penal Code.

3. The case of the prosecution is that the informant was returning from collection of Rs. 51,990/- and a tab in a handbag. It is alleged that three persons on a bike snatched his bag and fled away towards Samastipur.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. It is also submitted that the case was registered against unknown miscreants. The name of this petitioner has surfaced in the confessional statement of coaccused. It is next submitted that nothing has been recovered from the possession of this petitioner. The tab has been

Patna High Court CR. MISC. No.8325 of 2025(2) dt.19-03-2025 2/2 recovered from the possession of co-accused namely, Rajnish Kumar @ Jyoti Kumar @ Jyoti Singh. It is further submitted that the petitioner is languishing in judicial custody since 12.12.2023.

5. Learned APP appearing for the state has opposed the prayer of regular bail and submits that the petitioner is having criminal antecedents of 11 cases.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Bibhutipur P.S. Case No. 228 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Rosera, Samastipur.

7. Accordingly, the present bail application stands allowed with a condition that the petitioner shall cooperate in the stage of trial and shall remain physically present on each and every day.
