JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-01-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be cousin brother of wife of the deceased and according to prosecution case, the relation of the deceased with his wife was strained. Furthermore, it is alleged that deceased had gone to his Sasural with an intent to take back his wife but since then he was found missing. Admittedly, the dead body of victim of the present case has not been recovered as yet and parents in law and wife of the victim have already been granted privilege of anticipatory bail by a co-ordinate Bench of this court vide order dated 15.10.2015 passed in Cr. Misc. No. 31542 of 2015.
Patna High Court Cr.Misc. No.43730 of 2015 (3) dt.04-01-2016 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Biharsharif, Nalanda in connection with Rahui P.S. Case No. 34 of 2015.
