Smt. Binita Singh (SC28) ====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 22-06-2020 Due to COVID-19 Pandemic, the matter is being taken up by way of virtual Court proceeding.
The matter has been listed under the heading 'For Orders' under the orders of Hon'ble the Chief Justice. Heard the parties.
Following relief(s) have been sought for by the petitioner in the present writ application:
"(i) For issuance of an order, direction or writ including writ in the nature of Mandamus commanding the Respondents to
Patna High Court CWJC No.3588 of 2020(2) dt.22-06-2020 2/3 count the entire service period of the petitioner for the purposes of fixation of pension and payment of other retirement bene4fits.
(ii) For issuance of an order, direction or writ including writ in the nature of mandamus commanding the respondents to make payment of arrears and current pension month-to-month to the petitioner.
(iii) For issuance of an order, direction or writ including writ in the nature of mandamus commanding the respondents to make payment of gratuity, leave encashment, provident fund and group insurance to the petitioner with a statutory interest as well as interest on account of delay in the payment.
(iv) For issuance of an appropriate declaration holding that the petitioner is entitled to count the entire service period right from initial joining for the purposes of fixation of pension and payment of other retiral benefits".
Learned counsel for the petitioner is granted liberty to file a representation before the respondent No. 2 for redressal of his grievance.
In case, any such representation is filed, the
Patna High Court CWJC No.3588 of 2020(2) dt.22-06-2020 3/3 respondent No. 2 shall consider the representation of the petitioner and pass an appropriate order in accordance with law, within a period of four months from the date of filing/making of such representation.
With the aforesaid observation and direction, the present writ application stands disposed of.
