The petitioner seeks bail in connection with Special Case No. 358 of 2021 arising out of Kochadhaman P.S. Case No. 240 of 2021 instituted for the offences under Sections 272 and 273 and Section 30(a), 41, 32 and 47 of the Bihar Prohibition & Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner is in custody since 20.12.2021 is a person with clean antecedent, charge-sheet has been submitted in the case and allegation is of recovery of 626.4 liters of liquor from Tata Yodha Pick-up.

Learned counsel for the petitioner submits that the petitioner was not arrested from the spot and came to be

Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 20.12.2021 is a person with clean antecedent and chargesheet has been submitted in the case and was not arrested from the spot, let the petitioner above named be released on bail on furnishing bail bond of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge -II cum Special Judge (Excise Kishangan) in connection with Special Case No. 358 of 2021 arising out of Kochadhaman P.S. Case No. 240 of 2021.
