Heard Sri Yogesh Chandra Verma, learned Senior Counsel, assisted by Sri Anuj Kumar, learned counsel appearing on behalf of the petitioner and learned A.P.P. appearing for the State.

The petitioner, who is in custody since 10.06.2020 seeks regular bail in connection with Nauhatta P.S. Case No. 64 of 2020, for the offence punishable under Sections 147, 148, 149, 341, 323, 307, 379, 354(B) and 302 of Indian Penal Code, pending in the Court of learned Addl. Sessions Judge-V, Saharsa.

In compliance of order dated 16.11.2021, a report has been received vide letter No. 3531, dated 03.12.2021 from the Court of learned Sessions Judge I/C, Saharsa. It has been

Patna High Court CR. MISC. No.18699 of 2021(4) dt.17-01-2022 2/2 stated in the report that, in this case, the trial is to be completed within a period of 12 months.

Considering the stage of the trial, I am not inclined to release the petitioner on bail, at this stage. Accordingly, the prayer for grant of bail to the petitioner is rejected. It is expected of the Court below to conclude the trial expeditiously, preferably within a period of one year. If the petitioner so advised may renew his prayer for bail after one year, if no substantial progress takes place in the trial.
