JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-01-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody since 23.06.2015 in connection with Belhar P.S. Case No. 98 of 2012 registered for the offences punishable under Sections 302/34 of the Indian Penal Code. Petitioner is named in the First Information Report but informant is not an eye-witness of the alleged occurrence and in course of investigation at paragraph No. 85 of the case diary, one eye-witness claimed that it was co-accused Kailu Turi, who gave fatal blow to the deceased. Moreover, co-accused Baijnath Thakur and Shambhu Thakur, having more or less having similar allegation, has already been granted privilege of bail by different Benches of this Court.

Accordingly, the above named petitioner is directed to be

Patna High Court Cr.Misc. No.44470 of 2015 (3) dt.12-01-2016 P2/2 released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. VI, Banka in connection with Belhar P.S. Case No. 98/2012.
