JUSTICE PRABHAT KUMAR JHA ORAL ORDER 14-02-2019 Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in Manihari P.S. Case No.208 of 2018, registered under Sections 498(A)/34 of the Indian Penal Code as well as under Sections 3⁄4 of the Dowry Prohibition Act.
The informant alleged that she was married with the petitioner on 24.03.2018 and went to her Sasural but the petitioner again dropped her at her parents place on 04.04.2018 due to non-fulfillment of additional demand of dowry. Learned counsel for the petitioner submits that the petitioner was never married with the informant. In fact the
Patna High Court Cr.Misc. No.8774 of 2019(2) dt.14-02-2019 2/2 informant was married to one Sk. Iddu on 18.06.2017. Petitioner has falsely been implicated in the case.
Taking into consideration the facts that the petitioner has annexed the Nikahnama of the informant with Sk. Iddu and denied his marriage with the informant, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of this order be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Katihar in connection with Manihari P.S.
