Petitioners seek bail in a case registered for the offences punishable under sections 302/34 and other allied sections of the Indian Penal Code.
Informant named seven persons including petitioners Md. Zakir and Md. Ashique and asked from his father why he distributed land. Some verbal altercation took place and the accused persons assaulted his father with fists and slaps. Father of the informant died during the course of treatment. It is submitted that no injury either external or internal was found. Father of the informant was an old man. He died his natural death but the petitioners have been made accused
Patna High Court Cr.Misc. No.44054 of 2015 (2) dt.22-09-2015 in the case. From the post mortem report it appears that no apparent internal or external injury was found. Scrotum and penis was swollen but there was no mark of injury. Petitioners and others are alleged to have assaulted with fists and slaps. Considering the facts aforesaid, petitioners above named, are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Madhubani in connection with Babubarhi P.S. Case No. 84 of 2015.
