JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-02-2020 Petitioner seeks bail in connection with Sitamarhi Mahila P.S. Case No. 42 of 2019, registered for the offences punishable under Sections 323, 498A, 504 and 34 of the Indian Penal Code.
Petitioner happens to be husband of the informant and allegation against him is of assault and torture to her. Submission of learned counsel for the petitioner is that he is in custody for more than two months and charge sheet has already been submitted, as such there is no chance of tampering with the evidence.
Heard learned APP and learned counsel for the informant, who has opposed the prayer for bail. In view of above facts and circumstances, let

No.6801 of 2020(2) dt.05-02-2020 2/2 petitioner be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi, in connection with Sitamarhi Mahila P.S. Case No. 42 of 2019.
