Petitioner seeks bail in a case registered for the offences punishable under Sections 394,302 of the Indian Penal Code.

The FIR of the occurrence of robbery is against unknown.

Learned counsel for the petitioner has drawn attention of this Court to the order dated 11.04.2018 passed in Cr.Misc.No.9893 of 2018, whereby bail was granted to the petitioner in connection with Falka (Pothiya) P.S.Case No.397 of 2017, a case under Section 392 I.P.C. wherein the FIR was against unknown.

Submission is that soon after the petitioner

Patna High Court CR. MISC. No.7887 of 2019(3) dt.25-04-2019 2/2 came out of jail in pursuance of that order he has been implicated in the present case without any material against the petitioner, who is in custody since 04.12.2018. Investigation of the case is complete. He was never put on T.I.Parade during investigation nor any incriminating article was recovered from his possession.

Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Falka (Pothiya) Police Station Case No.459 of 2018, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
