Learned counsel has prayed for an adjournment on the ground that the earlier counsel has been disengaged, though no such vakalatnama is on the record in favour of learned counsel Md. Abu Haider. Because of the fact that during course of hearing of Title Appeal No.124 of 1980, learned counsel for the respondent/ one of the petitioners have their presence, but when it was their tern, they became absent and that being so, the Title Appeal was fixed for judgment and then, judgment was delivered. On that very score, the learned counsel for the petitioners was requested to explain the conduct of the party as well as learned counsel and on that very score, three adjournments have already been taken. Today also, again prayer in the same manner has been advanced. Accordingly, instant petition is dismissed.
