Petitioner is not named in the first information report but it appears from perusal of the impugned order that name of the petitioner came in this case in the information given by spy of the police and after that some witnesses also named the petitioner. Admittedly, petitioner has not been put on test identification parade and except the aforesaid material as well criminal antecedent, there appears to be nothing against him. Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi in Majorganj P.S.
