The petitioner seeks bail in Baligaon P.S. Case No. 137 of 2021, registered for the offence punishable under Section 307 and other allied sections of the Indian Penal Code. As per the prosecution case, this petitioner along with co-accused Rajesh Kumar entered into the house through the window and poured acid inside the house and also set the house on fire.

It is submitted on behalf of the petitioner that petitioner was not apprehended on the spot and no case under Section 307 and 326(a) is made out as none has sustained injury. Petitioner is in custody since 26.12.2021 having no criminal antecedent.

Patna High Court CR. MISC. No.8152 of 2022(3) dt.16-05-2022 2/2 Learned APP however, vehemently opposed the prayer for bail and submitted that bail application of similarly situated co-accused has been rejected by this court. Considering the facts aforesaid and the nature of allegation, I am not inclined to enlarge the petitioner abovenamed on bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) vinita/- U T
