JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 01-05-2024 At the outset, it is submitted on behalf of petitioner that the bail petition of petitioner No. 3 has already been withdrawn vide order dated 18.03.2024 .

2. Heard learned counsel for the petitioner Nos. 1 and 2 , informant and the State.

3 . Petitioners apprehend their arrest in a case registered for the offence punishable under sections 341 , 448 ,

Patna High Court CR. MISC. No.11275 of 2024(3) dt.01-05-2024 2/3 427, 324, 325 , 379, 506, 307 and 34 of the Indian Penal Code .

4. Allegation against both the petitioners is that they along with co-accused persons armed with weapons entered into the house of the informant and assaulted the informant and his family members. It is further alleged that they snatched golden chain from the informant side .

5 . It is submitted on behalf of the petitioners that due to land dispute and pending title suit between the parties a simple scuffle took place in which informant and other sustained injury . Allegation of assault is general and omnibus against these petitioners. No specific overt act is alleged against them. Petitioners claim clean antecedent.

6 Learned counsel for the State and informant vehemently oppose the bail petition.

7. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner Nos. 1 and 2 , as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM-I , Bikramganj , Rohtas in connection with Karakat P.S. Case No. 424 of 2023 , subject to the conditions laid down under section 438(2) of the Code of
