The petitioner seeks bail in a case instituted under Section 302 and other Sections of the Indian Penal Code. The informant named 96 persons in the first information report and alleged that they all came to the brick-kiln and brutally assaulted her husband. All the female members of the mob brought old tatti and straw of maize and put fire. Thereafter, the police came and recovered half burnt dead body of the husband of the informant.

It is submitted that the petitioner is not named in the first information report and no specific allegation is made against the petitioner. The police submitted charge-sheet against 41 accused persons and kept the investigation pending against the

Patna High Court Cr.Misc. No.45296 of 2015 (2) dt.29-09-2015 petitioner. Many similarly situated co-accused have already been enlarged on bail by different Benches of this Court. Considering the facts aforesaid, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, Ist Class, Purnia in connection with Dhamdaha P.S.
