JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-09-2016 The petitioner has renewed his prayer for bail in a case registered for the offences punishable under Sections 302/34, 354, 506, 323, 504 of the Indian Penal Code. The petitioner is the assailant of the victim. The petitioner is languishing in custody since 12.07.2009. The application of prayer for bail was rejected vide order dated 28.02.2012 passed in Cr. Misc. No. 5430 of 2012 with liberty to the petitioner to renew the prayer for bail if the trial is not concluded within a period of one year. More than 4 years and six months have elapsed but learned trial court failed to conclude the trial.

It is very fairly submitted by learned counsel for the petitioner that the evidence has been closed two months ago but till date the trial has not concluded. It is high time that the slumber of the learned

Patna High Court Cr.Misc. No.42550 of 2014 (8) dt.07-09-2016 2/2 trial court should break.

It is expected from the learned 5th Additional Sessions Judge, Patna to conclude the trial within a period of two months.

With the observations above, the application stands disposed of.
