The petitioner apprehends his arrest in Bakhri P.S. case No. 128 of 2017 registered under Section 30(d) of the Bihar Prohibition & Excise Act.
The informant got information that petitioner and other accused persons were preparing country made liquor but nobody was apprehended. Some aluminum pots containing country made liquor made of Mahua were recovered from a lonely place.
The learned counsel for the petitioner submits that there is nothing on record to show that petitioner was preparing country made liquor. The petitioner has got no criminal antecedent.

No.6756 of 2020(2) dt.11-06-2020 2/2 Considering the facts aforesaid and the fact that nothing has been recovered from the possession of the petitioner and petitioner has got no criminal antecedent, the petitioner, above named, in the event of his arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cumSpecial Judge, Excise Act, Begusarai in connection with Bakhri P.S. case No. 128 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
