The petitioner apprehends his arrest in a case registered for the offence under Section 307, 354(B), 379 & other allied sections of the Indian Penal Code. As per the F.I.R., all the F.I.R. named accused persons including petitioner and 15-20 unknown persons attacked the police party and got released one co-accused Sharif Yadav from police custody.

It is submitted on behalf of petitioner that allegation of attack is general and omnibus. No one has sustained grievous injury and no specific overt act has been alleged against this petitioner. Specific allegation of assault is against other coaccused. Petitioner has got no concern with co-accused Sharif Yadav and claims clean antecedent.

Learned A.P.P. for the State has opposed the prayer for bail.

No.7533 of 2022(2) dt.03-08-2022 2/2 Considering the aforesaid facts and circumstances as well as clean antecedent of petitioner, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Gaya in connection with Barachatti P.S. Case No. 661 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
