JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-09-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report and it appears that in course of investigation, some witnesses claimed to have seen the petitioner and some others going on stolen motorcycle. Furthermore, it would appear that the production warrant was issued against the petitioner in the year 2013 and he could be remanded in the present case in the year 2015. Moreover, petitioner is in jail custody since 22.01.2013. It is submitted on behalf of the petitioner that petitioner was remanded in the year 2011 in connection with another case but due to latches of the prosecution, he could not be remanded in this case in time.

No.43672 of 2015 (2) dt.21-09-2015 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Supaul in connection with Supaul P.S.Case No. 331 of 2009.
