JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 25-01-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 09.07.2015 on the allegation that he made attempt to commit rape on nine years old girl.

Taking note of allegation leveled against the petitioner, I do not feel it proper to release the petitioner on bail at least, at this stage, and accordingly, his prayer for bail in connection with Mahua P.S.Case No. 476 of 2014, pending in the court of learned 1st Additional District and Sessions Judge-cum-Special Judge ( POCSO Act), Vaishali at Hajipur, stands rejected. However, petitioner may renew his prayer for bail after examination of victim in trial.
