The petitioners seek pre-arrest bail in connection with Phulwarisharif (Janipur) P.S. Case No.891 of 2019 registered for the offence punishable under Sections 341, 323, 379 and 504 read with 34 of the Indian Penal Code. It is contended by the learned counsel for the petitioners that the petitioners have been implicated in this case falsely. It would be evident from the FIR that the occurrence took place on 20.09.2019 but no information about the occurrence has been given to the concerned police station and after expiry of two days, a written information regarding the occurrence has been given to the Officer-in-charge making a

Considering the nature of allegation and unexplained delay of two days in institution of the FIR, in the event of arrest or surrender in the court below, the petitioners are directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Judge-IXcum-ACJM, Patna in connection with Phulwarisharif P.S.
