Through this writ application, the petitioner seeks direction to the respondent concerned to consider the claim of petitioner's mother for grant of Senor Selection Grade Scale of Matric trained after completion of satisfactory service of 24 years in view of Bihar Nationalized Primary Teachers Promotion Rules, 1993 read with amended Rule, 2000.
A counter affidavit has been filed on behalf of respondent no.4 stating that the earlier letter issued by the Government of Bihar has been withheld vide order dated 1.04.2016 after the decision of this
Patna High Court CWJC No.13517 of 2016 dt.31-01-2017 2/2 Court and process for consideration of claim of the petitioner as well as other similarly situated persons has been initiated and a gradation list of teachers has been published on 25.06.2016 in which name of the petitioner's mother appears at sl.no.1177 of the said gradation list. It is further stated that the issue is under process and the same is to be placed in the meeting of the District Primary Promotion Committee for its consideration wherein the claim of the petitioner's mother shall be considered in accordance with law and if the petitioner's mother is found entitled by the Committee, the benefits of selection scale/gradeIII shall be granted to her. Accordingly, this writ application stands disposed of with a direction to the competent authority to convene the concerned meeting of the District Primary Promotion Committee and conclude the process within a period of three months from the date of receipt/production of a copy of this order.
