The petitioner apprehends his arrest in a case registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act.

13 litres of country made liquor has been recovered from the house of the petitioner.

Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. It is submitted that the petitioner has got no criminal antecedent as stated in paragraph-3 of the bail application. It is further submitted that there is no recovery from conscious possession of the petitioner.

Learned APP for the State opposed the prayer for

Patna High Court CR. MISC. No.9536 of 2023(2) dt.20-04-2023 2/2 grant of anticipatory bail to the petitioner by submitting that the said illicit liquor has been recovered from the house of the petitioner.

Considering the fact that said illicit liquor has been recovered from the house of the petitioner, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for grant of anticipatory bail to the petitioner is hereby rejected in connection with Rajgir P.S. Case No.684 of 2022, pending in the court of learned Additional District & Sessions Judge, 4th-cum-Exclusive Special Excise Court No.2, Nalanda. (Anjani Kumar Sharan, J) S.KUMAR/- U T
