2. The petitioner seeks bail in connection with Parbatta P.S. Case No. 335 of 2023 registered for the offence under Sections 307, 302, 379, 342, 34 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per the prosecution case, the petitioner is accused of firing on the deceased. The other accused persons have also assaulted the deceased. The deceased has sustained ante-mortem injuries and the fire arm injuries.

4. Learned counsel for the petitioner submits that the petitioner is in custody since 28.8.2023. It has been submitted by the learned counsel for the petitioner that the deceased was engaged in capturing land of co-villager, therefore, he has been killed by unknown persons.

5. Considering the fact that there is direct allegation of firing against the petitioner, therefore, this Court is not inclined to grant bail to the petitioner.

6. Accordingly, the prayer of bail of the petitioner is rejected herewith.
