2. The petitioner apprehends his arrest in a case registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act and Sections 317(4), 317(5), 3(5) of the B.N.S., 2023

3. As per F.I.R., 143.7 liters of Nepali country-made liquor has been recovered from a motorcycle.

4. Learned counsel for the petitioner submits that petitioner is neither owner nor driver of the seized motorcycle and has been made accused only on the basis of confessional statement of co-accused Sheikh Nasir.

5. However, learned A.P.P. for the State has opposed

Patna High Court CR. MISC. No.6552 of 2025(2) dt.03-03-2025 2/2 the bail petition and submitted that petitioner has got four criminal antecedent, out of which, one is of similar nature.

6. Considering the quantity of recovery and criminal antecedent of similar nature, the prayer for anticipatory bail of petitioner is rejected.
