The instant application has been filed for modification of order dated 02.08.2018 passed by this Court in Cr. Misc. No. 28448/2018 to the extent of enhancement of time for surrender before the court below and also for making correction in the name of petitioner.

Learned counsel for the petitioner has submitted that petitioner was granted anticipatory bail with condition to surrender within eight weeks and submit Bank Guarantee of equivalent to price of 211.72 quintals of CMR but petitioner could not furnish Bank Guarantee within time as ordered by this Court.

Learned counsel for BSFC is present.

Patna High Court Cr.Misc. No.6719 of 2019(2) dt.06-02-2019 2/2 Learned counsel for the petitioner has submitted that he will furnish Bank Guarantee within eight weeks. The instant petition is disposed off with modification in earlier order dated 02.08.2018 passed in Cr. Misc. No. 28448/2018, to the extent that petitioner will submit Bank Guarantee within eight weeks from the date of receipt of this order in the court below and in that event, the court below will release the petitioner on bail as per terms and conditions mentioned in the order dated 02.08.2018 passed in Cr. Misc. No. 28448/2018.

Learned counsel for the petitioner has pointed out that inadvertently in the original bail petition name of petitioner has been typed as Balelshwar Yadav in place of Baleshwar Yadav. Learned counsel for the petitioner seeks permission to make necessary correction in the name of petitioner in the original bail petition.

Learned counsel for the petitioner is given permission to make necessary correction in the name of petitioner in the original bail petition during course of day.

Let the name of petitioner in the said order be read as Baleshwar Yadav in place Balelshwar Yadav.
