JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 24-04-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under section-302 of the Indian Penal Code.
As per the prosecution case, the petitioner has committed the murder of niece of the informant. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case due to ill motive of the informant. Informant is not eye witness of the occurrence. Victim was mental patient and she committed suicide.
Learned counsel for the State opposes the prayer for bail. He submits that the petitioner is named in the FIR with specific allegation that he killed niece of the informant by
Patna High Court CR. MISC. No.8198 of 2023(2) dt.24-04-2023 2/2 administering her poison and threw the dead body in the maize crop.
Considering the nature and gravity of allegation, prayer for pre-arrest bail of the petitioner is rejected. (Prabhat Kumar Singh, J) Kaushik/- U T
