Although an omnibus allegation of assault has been alleged in the first information report against the petitioner and co-accused but in course of investigation, injured who happens to be an old lady, specifically, stated that it was the petitioner who gave lathi blow on her head. The injury on head of the injured has been found grievous in nature.

Therefore, I am not inclined to release the petitioner on bail, at least, at this stage and accordingly, his prayer for bail in connection with Rupauli P. S. case no. 70/2014 pending in the court of Sri P.K. Bharti, Judicial Magistrate, Ist Class, Purnea/ concerned court stands rejected.

However, petitioner may renew his prayer for bail after framing of the charge.
