Lastly, the bail application of petitioner was rejected vide order dated 21.09.2021 passed in Cr. Misc. No. 27009 of 2021.

Trial Court report reveals that till date only one witness has been examined and second witness has been partially examined on behalf of the prosecution. Learned counsel for the petitioner submits that petitioner is in custody since 02.03.2019 and similarly situated co-accused namely Dinesh Yadav has already been granted bail by co-ordinate Bench of this Court vide order dated 21.12.2022 passed in Cr. Misc. No. 43608 of 2022.

Considering the period of custody, progress of trial and the fact that similarly situated co-accused has already been granted bail, petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge XVII (18)-cum-Special Judge, Patna in Special Case No. 31 of 2019 arising out of F. No. NCB/PZU/V/07 of 2019.
