JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 08-04-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 379 of the Indian Penal Code.

It is a case of theft of motor cycle of the informant. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case only on suspicion. Petitioner has been remanded in this case from Bettiah (T) PS case No. 307/2021 registered under Section 30(a) of Excise Act. No stolen article has been recovered from the conscious possession of the petitioner. Petitioner is in custody since 28.05.2021 and investigation in this case is complete.
