JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23-09-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report but in course of investigation, he was arrested and allegedly, rupees one lac looted amount was recovered from his conscious possession. Petitioner confessed his guilt and accordingly, he was put on trial. In course of trial, one prosecution witness claimed to have identified him but the aforesaid witness admitted that petitioner was well known to him prior to the alleged occurrence as petitioner was engaged in the business of selling the buffalo and ox. So far as recovered amount is concerned, it is submitted on behalf of the petitioner that the aforesaid amount was of petitioner and not of looted money.

No.43513 of 2015 (2) dt.23-09-2015 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-I, Sheohar in connection with Sessions Trial No. 361 of 2012 arising out of Shyampur Bhatha P.S. Case No. 61 of 2011.
