The petitioner is the husband of the deceased and is facing accusation punishable under section 304-B/34 IPC in connection with Taraiya P.S. Case No. 01 of 2014. As per the FIR, the deceased was married to the petitioner about ten years ago. On receiving telephonic message about her unnatural death in the matrimonial home the informant rushed to the house only to find that her daughter was wholly burnt. The son of the victim was also injured. Accordingly, the FIR was lodged.

Learned counsel for the petitioner submits that marriage took place admittedly ten years ago. The allegation of demand of

Patna High Court Cr.Misc. No.41938 of 2014 (3) dt.21-01-2015 2 / 2 dowry therefore is not applicable. The petitioner is in custody since 02.08.2014.

Having heard the arties, considering the allegation levelled against the petitioner and materials reflecting from the impugned order, this Court is not inclined to direct release of the petitioner.

The application is dismissed.

The court in seisin of the matter shall now take up the trial of the petitioner and conclude the same expeditiously. (Kishore Kumar Mandal, J) HR/- U
