Petitioner seeks bail in a case registered for the offences punishable under sections 302 and other allied sections of the Indian Penal Code and section 27 of the Arms Act. Son of the deceased alleged that Sharan Yadav, Sado Yadav and Rudal Yadav (petitioner) came to his cattle shed and on the order of Sado Yadav and Rudal Yadav, Sharan Yadav fired which hit on the back of his father.

It is submitted that petitioner is an order giver. Sado Yadav is also an order giver. He has already been enlarged on bail. Assailant of the deceased is Sharan Yadav. Case of the petitioner stands on the same footing as that of Sado Yadav.

Patna High Court Cr.Misc. No.45245 of 2015 (2) dt.29-09-2015 Considering the facts aforesaid, petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Asthawan P.S. Case No. 33 of 2015.
