The petitioner is in custody since 5-8-2014 for the offences punishable under Sections 413, 414 and 34 of the Indian Penal Code.

The allegation against the petitioner is that the stolen motorcycle was recovered from the Verandah of the house of the petitioner.

It is submitted that the recovery has not been made from the conscious possession of the petitioner. The petitioner has no

Considering the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran,in Garkha P.S. Case No. 4/14 with the following conditions:

1. One of the bailors will be the close relative of the petitioner.

2. The petitioner will not indulge in similar or in any other offence.

3. The petitioner will be well represented in the court.
