The petitioner is languishing in custody since 06.08.2014 in a case registered for the offences punishable under Sections 147, 148, 149, 448, 341, 323, 324 and 307 of the Indian Penal Code.

It is alleged that the petitioner assaulted with iron rod on the head of the informant.

It is submitted by learned counsel for the petitioner that during investigation the witness has suggested in para 29 of the case diary that Sadre Alam also assaulted on the head of the informant when only one injury has been found. Though, the final opinion of the alleged injury has not been

Patna High Court Cr.Misc. No.42911 of 2014 (03) dt.04-03-2015 2/2 brought on record till date. It is further submitted that the accusation of repetition of blow has not been alleged. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhubani in connection with Sakari P.S.
