The petitioner seeks bail in connection with Hiramma P.S. Case No. 75 of 2022 registered for the offence punishable under Sections 363 and 366(A) of the Indian Penal Code. The allegation against the petitioner is that the informant's daughter was kidnapped by the petitioner while returning from coaching with an intention to marry her. Learned counsel for the petitioner submits that the victim girl has recorded her statement under Section 164 of the Cr. P.C. that she loves the petitioner and had fled away with him for marriage but they have not solemnized marriage and returned to her house. Learned counsel submits that the petitioner has no criminal antecedent and he is aged about 20
Patna High Court CR. MISC. No.8027 of 2023(2) dt.03-05-2023 2/2 years. A charge-sheet has already been filed and there is no chance of his absconding or tampering with the evidence if released on bail. Learned counsel submits that the petitioner is in custody since 22.10.2022.
Learned APP for the State has opposed the prayer for regular bail of the petitioner.
Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate- Ist Class, Sheohar in connection with Hiramma P.S. Case No. 75 of 2022.
