JUSTICE SUDHIR SINGH ORAL ORDER 01-12-2015 Since both petitions arise out of S.T. no. 260 of 2015 corresponding to Barari P.S. case no. 72 of 2015, they have been heard together and are being disposed of by this common order. The petitioners of both petitions seek bail in a case instituted under Section 302/34 of the Indian Penal Code. Allegation against the petitioners is that they along with other accused persons assaulted and killed the husband of the

It has been submitted on behalf of the petitioners that they have got no criminal antecedent. They are in custody since 2.5.2015. Chargesheet has been submitted in both the present applications. There is no allegation of tampering of evidence against the petitioners. There is no specific allegation against the petitioners. Petitioners have been made accused on the basis of suspicion. There is no eye witness to the alleged occurrence. On behalf of the State, it is submitted that petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Katihar , in connection with S.T. no. 260 of 2015 arising out of Barari P.S. Case no. 72 of 2015.
