JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 20-02-2019 Neither learned counsel for the petitioner is present nor anyone appears on behalf of the State to represent this case. This application has been preferred seeking anticipatory bail in connection with Sadar Hajipur P.S. Case No. 365 of 2018 registered for the offences punishable under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016. It appears from perusal of the records that a raid was conducted in the house of Chandeswar Rai and 9 liters of liquor were recovered from the first floor of the said house. In the First Information Report, Chandeswar Rai has been described as owner of the house, he was also arrested in course of raid. It is alleged that this petitioner being son of Chandeswar Rai was involved in sale of liquor.

No.10332 of 2019(2) dt.20-02-2019 2/2 Since, the house in question has been shown in the name of Chandeswar Rai as per seizure list and he has already been arrested in course of raid, taking note of the submission made in Paragraph 3 of the application that the petitioner has got no criminal antecedent, in case of arrest or surrender of the petitioner within a period of four weeks from today, the abovenamed petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.15,000/- (rupees fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-2-cum-Special Judge Excise, Hajipur, Vaishali in connection with Sadar P.S. Case No. 365 of 2018, subject to the condition that petitioner shall join the investigation by reporting to the Investigating Officer within a period of two weeks from today and shall cooperate in course of investigation. This will be in addition to condition prescribed under Section 438(2) of the Cr.P.C.
