JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-02-2019 This application, for grant of anticipatory bail, arises out of Danapur P.S. Case No. 547 of 2017, disclosing offences under Sections 147, 148, 149, 341, 323, 302 and 120B of the Indian Penal Code and Section 27 of the Arms Act. Allegation against the petitioners and others is that they came armed with pistol on motorcycle and some of the coaccused persons fired on the brother of informant, who died in hospital.

Submission of learned counsel for the petitioners is that there is no allegation of firing or assault to anyone has been attributed to the petitioners and at best, they can be said to be the member of mob. Moreover, other accused persons have already been granted the privilege of anticipatory, which he has

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Cheif Judicial Magistrate, Danapur, in connection with Danapur P.S. Case No. 547 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
