The petitioner seeks regular bail in connection with Khajauli PS case no. 127 of 2018 registered for the offence punishable under Section 307 and other sections of Indian Penal Code.
The allegation is regarding unknown accused persons having assaulted the informant and subsequently, some of the accused persons are said to have been arrested. The name of the petitioner is transpired during the course of confessional statement made by one co-accused namely Rudra Kr. Ram. The learned counsel for the petitioner submits that the petitioner is innocent and there is no evidence with regard to the petitioner having committed the alleged crime.
Patna High Court Cr.Misc. No.8626 of 2019(2) dt.14-02-2019 2/2 Moreover, no test identification parade has been held till date in order to connect the petitioner with the alleged crime. It is further submitted that the petitioner is having clean antecedent and he is languishing in custody since 23.07.2018. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.
Accordingly, the abovenamed petitioner is directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 3rd, Madhubani in connection with Khajauli PS case no. 127 of 2018.
