JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 02-03-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is seeking anticipatory bail in connection with Sheohar P.S. Case No. 282 of 2019 registered under Sections 30(a) of the Bihar Prohibition & Excise Ac, 2016, pending in the court of learned 1st Additional Sessions Judge - cum - Special Judge, Excise, Sheohar.
Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case. The country made liquor has been recovered from the Bhusaula hut of the petitioner and petitioner has got no criminal antecedent.
Learned A.P.P. for the State has opposed the
Patna High Court CR. MISC. No.7458 of 2020(2) dt.02-03-2020 2/2 prayer for anticipatory bail of the petitioner. Considering the facts and circumstances of the case wherein the illicit liquor is said to have been recovered from the Hut of this petitioner, I am not inclined to grant anticipatory bail to the petitioner.
Prayer for anticipatory bail of the petitioner is, thus, refused.
In case, petitioner surrenders and prays for regular bail in the court below within a period of four weeks from today, his prayer for regular bail shall be considered on it's own merit without being prejudiced by the orders of this court.
