The petitioner is languishing in custody since 15.12.2018 in a case registered for the offences punishable under Sections of the I.P.C. and Sections 30(a) and 41(i) of the Bihar Prohibition and Excise Act, 2016.

The prosecution case is that from the fodder room of the petitioner, 720 litres illicit liquor were recovered. It is submitted by learned counsel for the petitioner that the fodder room has no door and it is exposed to the public at large. The petitioner is accused in one other case of similar nature in which he is on bail. Moreover, the fodder room is joint family property.

Learned APP submits that the recovery has been made from the fodder room of the petitioner.
