The petitioner seeks bail in Muzaffarpur Town P.S. Case No. 37/14 under Sections 366(A)/120B/34 of the Indian Penal Code.
Md. Shamshad alleged that his daughter was kidnapped by Md. Munna and his friend Wasim. Md. Munna happens to be the brother of the son-in-law of the petitioner Md. Majju. It is alleged that both were seen at the house of Md. Majju on the date of occurrence. It is submitted that the petitioner is not at all involved in the kidnapping of the daughter of the informant. Victim Sama Praveen made her statements under Section 164 of the Code of Criminal Procedure and she disclosed the name of Amna Khatoon, who asked her to accompany with Md. Munna and Wasim and they took her to different places after
Patna High Court Cr.Misc. No.42207 of 2014 (4) dt.16-04-2015 2/2 administering intoxicating substance.
Considering the fact that even the victim did not name the petitioner in her kidnapping, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 7th Additional / 3rd Adhoc Additional Sessions Judge, Muzaffarpur in Town P.S. Case No. 37/14, corresponding to S. Tr. No. 597/14.
