The petitioner has prayed for bail in connection with Khaira P.S. Case No. 267 of 2022 instituted for the offence under Sections 8, 20(b)(ii)(c), 25/29 of the N.D.P.S. Act. As per F.I.R., prosecution case relates to recovery of 65 packets total weighing about 575.5 kg of incriminating substance like Ganja from a truck bearing Registration no. NL01AA-0511. The petitioner is said to be apprehended on spot with the seized truck.

Learned counsel for the petitioner submits that the petitioner is innocent and committed no offence. He has falsely been implicated in this case. The petitioner has no concern with the alleged recovery of contraband ganja or with the vehicle in

Patna High Court CR. MISC. No.7900 of 2023(3) dt.15-05-2023 2/2 question. It is further submitted that the petitioner is languishing in judicial custody since 13.7.2022.

Learned APP appearing for the state has opposed the prayer of regular bail and submitted that the petitioner is alleged to be involved in transporting of contraband ganja and he was arrested on spot. The recovery of contraband ganja is alleged to be 575.5 kg which is much more than commercial quantity. It is further submitted that the petitioner has got one criminal antecedent of similar nature. Prosecution witnesses also supported the allegation against the petitioner. Having heard the learned counsel for the parties and considering the nature of allegation, this court is not inclined to enlarge the petitioner on bail and, as such, his prayer for bail stands rejected.

The trial Court is directed to expedite the trial and conclude the same as soon as possible.
