The petitioner is in custody since 22.07.2014 in a case for the offence registered under Section 379 of the Indian Penal Code.

The allegation against the petitioner is that the petitioner was seen alongwith the motorcycle in question. However, learned counsel for the petitioner submits that the owner of motorcycle has not lodged the present First Information Report rather one Raju Kumar Jha, who is not the owner of the motorcycle has lodged the First Information Report after unusual delay of 17 days.

Considering the aforesaid submissions and also the fact that the petitioner has no criminal antecedents and has been custody since 22.07.2014, let the petitioner, above

Patna High Court Cr.Misc. No.42944 of 2014 (3) dt.03-03-2015 named be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M., Muzaffarpur in connection with Kazi Mohammadpur P.S. Case No. 273 of 2014.
