JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-04-2019 Petitioner seeks bail in anticipation of her arrest in connection with Mithanpura P.S. Case No. 394 of 2018, registered for the offences punishable under Sections 420, 290/34 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act.

Allegation is of recovery of 57 litres of liquor from the litchi orchard and petitioner is accused in one more case. Submission of learned counsel for the petitioner is that the orchard does not belong to the petitioner and she has been made accused only on the basis of confessional statement of co-accused that petitioner is doing business with one Dilip Kumar Kushwaha and earlier also a case has been lodged against her in which she is on bail.

Having heard both sides and in the facts and circumstances, let petitioner, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise Act, Muzaffarpur, in connection with Mithanpura P.S.Case No. 394 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned and further condition is that if petitioner is involved actively in such type of cases in future, prosecution is given liberty to move for cancellation of her bail bonds. Let a copy of this order be sent to the Superintendent of Police, Muzaffarpur for needful.
