1. Heard learned counsel appearing on behalf of the petitioner and learned Additional Public Prosecutor appearing on behalf of the State.

2. The accused/petitioner is named in F.I.R. and apprehending his arrest in connection with Makhdumpur P.S. Case No. 707 of 2023, registered for the offences punishable under Sections 341, 323, 379, 384, 504, 506/34 of the Indian Penal Code.

3. The allegation against above named petitioner is to assault informant and demanded Rs. 50,000/- as extortion

Patna High Court CR. MISC. No.8715 of 2024(2) dt.20-02-2024 2/3 money, where in furtherance of said demand cash of Rs. 6500/- and golden chain worth of Rs. 41,000/- was snatched from informant. It is further alleged that Rs. 8000/- was transferred online to petitioner.

4. Learned counsel appearing on behalf of the petitioner submitted that petitioner was not present at the place of occurrence as per FIR itself and his implication only appears for the reason that he is holder of one alleged mobile bearing no. 990535791. It is submitted that petitioner is not the holder of aforesaid mobile number, where Rs. 8000/- alleged to be transferred. It is submitted that petitioner is a man of clean antecedent.

5. Learned APP opposes the prayer of bail.

Considering the aforesaid facts and circumstances, as petitioner not appears available during the occurrence, accordingly, above named petitioner, in the event of his arrest or surrender before the learned trial Court, within a period of four weeks of the order, is directed to be released on bail furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-I, Jehanabad/concerned Court, where the case is pending in connection with Makhdumpur P.S. Case No. 707 of

Patna High Court CR. MISC. No.8715 of 2024(2) dt.20-02-2024 3/3 2023, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
