1. Heard learned counsel for the petitioner and learned APP for the State along with learned counsel for the informant.

2. The petitioner seeks regular bail in connection with Sessions Trial No. 796 of 2023 arising out of Hulasganj P.S. Case No. 26 of 2023, registered for the offences punishable under Sections 302, 201, 34 of the Indian Penal Code.

3. As per the prosecution case, the daughter of the informant was killed due to dowry demand by the accused persons including the petitioner.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in the present case due to suspicion. He further submits that the deceased was living happily with her husband (petitioner) since fourteen years and had given birth of three daughters and one

Patna High Court CR. MISC. No.9013 of 2024(3) dt.26-04-2024 2/2 son. He further submits that suddenly she felt chest pain and when she was proceeded for treatment, she died in the way. He further submits that due to wrong information, the informant has filed the present case against the petitioner and other co-accused persons. Similarly situated co-accused, namely, Mugeshwar Yadav and Saroj Devi have been enlarged on regular bail by this Court vide order dated 15.01.2024 passed in Cr. Misc. No. 82713 of 2023. Petitioner has no criminal antecedent and he is in judicial custody since 09.06.2023.

5. Learned APP for the State has submitted that he has no objection to the prayer for regular bail of the petitioner.

6. Considering the facts and circumstances of the case and the submissions of learned counsels for the parties, let the petitioners, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VII, Jehanabad in connection with Sessions Trial No. 796 of 2023 arising out of Hulasganj P.S. Case No. 26 of 2023.
