====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR JHA ORAL ORDER 16-04-2024 Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. In the present case, the petitioners are apprehending their arrest in connection with Barachatti P.S. Case No. 261 of 2020, registered on 09.05.2020 for the offences under Sections 341, 353, 504, 506 and 34 of the Indian Penal Code.

3. As per the prosecution case, the petitioners demanded commission from the payment made by the informant who has been working as Programme Officer and threatened him with life on non-fulfillment of their demand. The informant

Patna High Court CR. MISC. No.8696 of 2024(3) dt.16-04-2024 2/3 has further alleged that the petitioners by making a caucus used to pressurized him for doing wrongful act.

4. Learned counsel appearing on behalf of the petitioners submits that the petitioners are innocent and have been falsely implicated in this case as the petitioners opposed the corruption in the office of the informant. The petitioners were sitting on dharna before the office of the informant and they never threatened the informant and never demanded any extortion from him. The matter was investigated by police but none of the witnesses who are the staff of the office of the informant support the case of the informant. The petitioners have got clean antecedent.

5. Learned A.P.P. appearing for the State opposes the submission made on behalf of the petitioners.

6. Having regard to the fact and circumstances and submission made on behalf of the parties and considering the general and vague nature of allegation and probability of false accusation, the petitioners above named, in the event of their arrest or surrender before the court concerned within a period of eight weeks from today, be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of

(i) One of the bailors will be a close relative of the petitioners.

(ii) The petitioners will remain present on each and every date fixed by the below, if so required by the learned trial court.
