For the Petitioner :

Mr. Devendra Kumar, Advocate For the State :

Dr. Anshuman, S.C.14 =========================================================== CORAM: HONOURABLE MR. JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 29-09-2016 The order of transfer contained in Annexure-1 seems to be a routine transfer and an annual general transfer. The challenge thrown by the petitioner to the said notification contained in Annexure-1 dated 30.06.2016 on the ground that there is a communication or letter of the Principal Secretary not to transfer the Revenue Karamcharis is a misplaced kind of emphasis since the communication contained in Annexure-4/1 dated 12.03.2015 was written in the context of the closing of the financial year and need not to transfer such Karamcharis. It is not a communication for all times to come.

The exigencies of service in the requirement of posting

Patna High Court CWJC No.11536 of 2016 dt.29-09-2016 2 / 2 of such persons seem to be the sole object and purpose for such transfer. The Court is not convinced that interference is made out merely because the petitioner's name figures in the list of transferees. Writ has no merit. It is dismissed.
